Privacy Policy

Transcontinent Technologies, Inc., a Delaware corporation ("Transcontinent," "we," "us," or "our"), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and safeguard information when you visit our website at transcontinent.ai, use our translation CDN platform, APIs, dashboards, and related services (collectively, the "Service"). This Privacy Policy applies to all users of the Service, including account holders, site visitors whose content is processed through the Service, and visitors to our marketing website.
By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our data practices, do not use the Service.
1. Information We Collect
1.1 Account and Registration Information
When you create an account, we collect your name, email address, and authentication credentials through our identity provider (currently Clerk). We also collect billing information, including payment method details, billing address, and tax identifiers, processed securely through our payment providers (currently Polar and/or Stripe). We do not store full payment card numbers on our own servers.
1.2 Site Content Processed for Translation
When you connect a site to Transcontinent, our pipeline workers crawl publicly available pages on your origin domain to extract translatable content segments. This content is processed transiently for translation purposes and cached at the edge via Cloudflare Workers KV and R2. We do not store your origin content beyond what is necessary for active translation delivery. You are solely responsible for ensuring that the content you submit to the Service does not include sensitive personal data (e.g., Social Security numbers, financial account numbers, health data) unless you have obtained all required consents and authorizations.
1.3 Usage and Analytics Data
We collect usage data including page views, API call volumes, translation segment counts, cache hit rates, edge location distribution, feature usage patterns, and dashboard interaction data. This data is used to operate, improve, and optimize the Service and for billing calculations.
1.4 Log and Technical Data
Our infrastructure automatically records request metadata such as IP addresses, browser user agents, device identifiers, operating system information, referring URLs, request timestamps, and error logs. This data is collected for security, debugging, abuse prevention, and compliance purposes.
1.5 Communications
When you contact us via email, support channels, or feedback forms, we collect the content of your communications and any information you voluntarily provide.
1.6 Information from Third Parties
We may receive information about you from third-party services you use to authenticate (e.g., OAuth providers), from payment processors regarding transaction status, and from publicly available sources.
2. How We Use Your Information
We use the information we collect to:
- Provide, operate, maintain, and improve the Service
- Process translations through our holding, rough, and final progressive pipeline
- Generate and maintain brand profiles for translation fidelity
- Calculate billing, enforce budget guardrails, and process payments
- Send transactional communications (locale reports, billing alerts, launch notifications, account security notices)
- Monitor for abuse, enforce rate limits, detect fraud, and maintain security
- Improve translation quality and platform performance
- Generate aggregated, anonymized, or de-identified analytics and benchmarking data
- Comply with legal obligations, enforce our Terms of Service, and protect our rights and the rights of others
- Respond to your inquiries, requests, and support tickets
3. Data Controller and Processor Roles
Transcontinent acts as a data controller with respect to personal data we collect directly from you (account information, billing details, usage data, and log data). Transcontinent acts as a data processor with respect to any personal data contained within your origin Content that we process for translation on your behalf. As a processor, we process such data only as necessary to provide the Service and in accordance with your instructions. You remain the controller of any personal data embedded in your Content and are responsible for ensuring a lawful basis for its processing.
4. Data Processing and Edge Delivery
Transcontinent operates on Cloudflare's global edge network. Translated content is cached and served from the edge location nearest to each visitor. Content processing occurs in Cloudflare Workers and Durable Objects. Your origin content is fetched, segments are extracted, translations are generated via AI providers, and the resulting translations are stored in Cloudflare Workers KV and R2. This means your Content and Translations may be processed and stored in multiple jurisdictions worldwide wherever Cloudflare maintains infrastructure.
Translation memory and human corrections are scoped per-site and are not shared across accounts. We do not use your Content or Translations to train third-party AI models. However, AI translation providers process content transiently under their own data processing terms; we select providers that commit to not retaining customer content for model training.
Sensitive Personal Information
We do not intentionally collect "sensitive personal information" or "special category data" as defined under applicable privacy laws (e.g., racial or ethnic origin, religious beliefs, health data, biometric identifiers, sexual orientation, precise geolocation, or government-issued identification numbers). If your origin Content contains such data, you are solely responsible for ensuring that all required consents, safeguards, and legal bases are in place before submitting it to the Service.
5. How We Share Information
We do not sell your personal information. We may share information in the following circumstances:
5.1 Service Providers
We share information with third-party service providers who perform services on our behalf, subject to contractual obligations to protect your data:
- Cloudflare — Edge delivery, caching, DNS, DDoS protection, and worker execution
- Clerk — Authentication and identity management
- Polar / Stripe — Payment processing and subscription management
- AI translation providers — Natural language translation (content is processed transiently)
- Vercel — Hosting for the control plane dashboard
5.2 Legal and Compliance
We may disclose your information if required to do so by law, in response to valid legal process (subpoena, court order, or government request), to protect the rights, property, or safety of Transcontinent, our users, or the public, to enforce our Terms of Service, or to detect, prevent, or address fraud, security, or technical issues.
5.3 Business Transfers
If Transcontinent is involved in a merger, acquisition, reorganization, bankruptcy, asset sale, or similar transaction, your information may be transferred as part of that transaction. We will provide notice before your information becomes subject to a different privacy policy.
5.4 Aggregated and De-Identified Data
We may share aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you with third parties for any purpose, including industry analysis, benchmarking, research, and marketing.
5.5 With Your Consent
We may share your information with third parties when you give us explicit consent to do so.
6. International Data Transfers
Transcontinent is based in the United States. By using the Service, you acknowledge that your information may be transferred to, stored, and processed in the United States and other countries where our service providers maintain infrastructure, which may have data protection laws that differ from those in your jurisdiction. For transfers of personal data from the European Economic Area ("EEA"), United Kingdom, or Switzerland to the United States, we rely on Standard Contractual Clauses approved by the European Commission or other lawful transfer mechanisms. By using the Service, you consent to such transfers.
7. Data Retention
We retain your information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law:
- Account data: Retained for the duration of your subscription and for up to 90 days after account closure to allow for reactivation and dispute resolution, after which it is deleted or anonymized.
- Translated content caches: Invalidated when you disconnect a site, when origin content changes, or within 30 days of account termination.
- Log data: Retained for up to 90 days for security and debugging purposes, then automatically purged.
- Billing records: Retained as required by applicable tax, financial, and accounting regulations (which may extend for several years).
- Aggregated data: May be retained indefinitely in de-identified form.
We may retain certain information as required by law or for legitimate business purposes, including fraud prevention, dispute resolution, enforcement of our agreements, and compliance with litigation holds or legal preservation obligations.
8. Your Rights and Choices
Depending on your jurisdiction, you may have certain rights regarding your personal data. To exercise any of these rights, contact us at privacy@transcontinent.ai. We will respond to verified requests within the timeframes required by applicable law.
8.1 Identity Verification
Before processing any data rights request, we must verify your identity to protect against unauthorized access, deletion, or modification of data. We may ask you to provide information that matches our records (such as the email address on your account) or to authenticate through your account credentials. We reserve the right to deny requests that we cannot verify or that are manifestly unfounded, excessive, or repetitive, as permitted by applicable law.
8.2 GDPR (European Economic Area and United Kingdom)
If you are in the EEA or UK, our legal bases for processing personal data are:
- Contract performance: Processing necessary to provide the Service under our Terms of Service
- Legitimate interest: Security, abuse prevention, service improvement, and aggregated analytics, balanced against your rights
- Legal obligation: Tax, accounting, and regulatory compliance
- Consent: Marketing communications (which you may withdraw at any time)
You have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. You may also lodge a complaint with your local supervisory authority. Note that certain rights may be limited where we have a compelling legitimate interest or legal obligation.
8.3 CCPA / CPRA (California)
California residents have the right to: (a) know what personal information we collect, use, and disclose; (b) request deletion of personal information; (c) opt out of the "sale" or "sharing" of personal information; (d) non-discrimination for exercising these rights; and (e) limit the use and disclosure of sensitive personal information. We do not sell or share personal information as defined under the CCPA/CPRA. We do not use or disclose sensitive personal information for purposes beyond those permitted under California law. To submit a request, email privacy@transcontinent.ai with the subject "California Privacy Request." You may also designate an authorized agent to make a request on your behalf; we may require verification of both your identity and the agent's authority.
8.4 Other U.S. State Privacy Laws
Residents of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA), Texas (TDPSA), Oregon (OCPA), Montana (MCDPA), and other states with comprehensive privacy laws may have rights to access, correct, delete, and port their personal data, and to opt out of targeted advertising, profiling, and the sale of personal data. We honor these rights upon verified request. To exercise your rights or appeal a denied request, email privacy@transcontinent.ai with the subject "State Privacy Request."
8.5 Other International Jurisdictions
If you are located in a jurisdiction with data protection laws that grant you specific rights (e.g., Brazil LGPD, Canada PIPEDA, Australia Privacy Act, Japan APPI, South Korea PIPA), we will honor applicable rights upon verified request.
9. Automated Decision-Making
The Service uses automated processing to generate translations, create brand profiles, detect abuse, enforce budget guardrails, and classify content. These automated processes do not produce legal effects concerning you or similarly significantly affect you. If you believe an automated decision has adversely affected you, you may contact us at privacy@transcontinent.ai to request a manual review.
10. Security
We implement industry-standard administrative, technical, and physical security measures to protect your information, including TLS encryption in transit, encryption at rest for stored data, signed internal actions between system components, role-based access controls, regular security assessments, and restricted and audited access to production systems. However, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your information, and you transmit data to us at your own risk.
11. Data Breach Notification
In the event of a security breach involving personal data, we will notify affected users and relevant supervisory authorities as required by applicable law. Notification will include, to the extent known, the nature of the breach, the categories of data affected, likely consequences, and measures taken to address the breach. Our obligation to notify does not constitute an admission of fault or liability.
12. Cookies and Tracking Technologies
We use strictly necessary cookies for authentication and session management on the control plane dashboard. We do not use advertising or third-party tracking cookies. Our edge delivery layer does not set cookies on translated pages unless required by your origin site. We may use first-party analytics tools to understand usage patterns. You can control cookie settings through your browser; however, disabling necessary cookies may impair Service functionality.
13. Children's Privacy
The Service is not directed to individuals under the age of 16 (or the minimum age of digital consent in your jurisdiction). We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under the applicable age, we will take steps to delete that information promptly. If you believe a child has provided us with personal data, please contact us at privacy@transcontinent.ai.
14. Do Not Track
Some browsers transmit "Do Not Track" signals to websites. Because there is no industry consensus on how to respond to such signals, we do not currently respond to browser-based Do Not Track signals. We do, however, honor the Global Privacy Control ("GPC") signal where required by applicable law.
15. Third-Party Links
The Service may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.
16. Data Processing Agreement
If you require a Data Processing Agreement ("DPA") for GDPR or other regulatory compliance, contact us at privacy@transcontinent.ai. Scale plan customers may execute a DPA as part of their enterprise agreement.
17. Limitation of Liability for Privacy Claims
To the fullest extent permitted by applicable law, any claim related to this Privacy Policy or our data practices is subject to the limitation of liability and dispute resolution provisions in our Terms of Service, which are incorporated herein by reference.
18. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. Material changes will be communicated via email to account holders and posted on this page with an updated effective date. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Privacy Policy. We encourage you to review this page periodically.
